An Alameda County judge cleared David Xu’s felony conviction on October 12, 2026, after he completed two years of probation in a case involving a poisoned co-worker.
Xu, 41, pleaded no contest in 2023 to poisoning Rong Yuan at Berkeley Engineering and Research. Yuan and prosecutors opposed his request to dismiss the conviction, District Attorney Ursula Jones Dickson said.
After nearly two years of unexplained illness, Yuan placed a hidden camera by her desk. It recorded Xu adding a substance to her water bottle in March 2019. Berkeley police later detected cadmium, a toxic heavy metal, at exceptionally high levels in the water.
Yuan said she faulted California law rather than the judge, whom she believed was required to approve the petition. Dickson expressed hope that the survivors would continue to heal physically and emotionally.
