The Trump administration announced Thursday that it was suspending Microsoft and Adobe from a federal program involved in the employment-based green card process. Immigration attorneys advised H-1B employees at those companies and other named tech firms to seek legal counsel about their individual status.
The suspensions concern Permanent Labor Certification, known as PERM. Employers generally must complete this step before sponsoring a worker for an employment-based visa, demonstrating that no qualified, available U.S. worker can fill the position.
Vice President JD Vance accused Microsoft of laying off American workers while using the program to hire foreign workers at lower pay. Some immigration attorneys said the suspensions were likely to face court challenges; one suggested they would affect a relatively small group of workers. The attorneys offered general guidance, noting that individual circumstances could differ.
