A Tarrant County jury awarded Ronny and Mandy McCoy $21.6 million in a case over defects in their home, the couple’s attorneys announced Wednesday.
The McCoys had reported a foul odor before closing on the house in November 2018. Nearly six years later, a plumber found that vents were emptying into the attic and letting sewer gas circulate inside, according to their lawsuit. The family was forced from the home amid sewer gas and mold problems.
Jurors found NAE Enterprises, which operates as NAE Contracting, liable for construction defects, the attorneys said. The award includes $10 million in punitive damages against the contractor. The attorneys said the verdict also covered negligence, a breach of warranty and violations of a Texas consumer protection law that jurors found were knowing and intentional.
The attorneys said jurors assigned 77% of the responsibility to NAE Enterprises and 10% each to Dauenhauer & Associates and Ricky Dauenhauer.
